Terms & Conditions of Participation
Draw Organizer.
1.The Limited Partnership under the name "KYOTO ECONOMICS E.E." and the distinctive title "KYOTO" (hereinafter referred to as the "Organiser"), based in Agioi Anargyroi, Attica, at G. Papandreou no. 124, 13562, organizes the following promotion through a Draw entitled "Request an offer and enter the draw" (hereinafter referred to as the
"Draw") with the following terms of participation (hereinafter the "Terms"), which will be posted and updated continuously during the registration period, on the website of www.kyotoenergy.gr (hereinafter referred
to as the "Website").
2.Candidates must ensure that they are promptly informed about any changes to the terms of the Draw by visiting the Website.
3.The purpose of these terms is to determine the terms of participation in the Draw, as well as the relevant nomination of the winner in the context of this Draw.
4.Participation in the Draw constitutes automatic and unconditional acceptance of all the terms and procedures of the Draw, without exception, as included herein and as updated on the Website.
Duration of securing participation in the Draw.
5.Participation is set until August 30, 2024 at 23:59:59 p.m. (Greek Local Time) (hereinafter the Duration").
Participation in the Draw.
6.Each participant in the draw participates with one ticket for every 5000 Euro of offer.
7.All valid entries are registered in a list (database) and automatically and without any other benefit, the appropriate number of tickets for participation in the draw. The Organiser bears no responsibility whatsoever if for reasons beyond its control (such as, but not limited to, force majeure, technical problems, line overload, server crash) the retained files are partially or fully destroyed.
8. In the event that, in Kyoto's judgment, entry does not comply with these Terms and Conditions of the Prize Draw or the entry is, in Kyoto's sole discretion, the result of illegal technical influence on its systems or fraud or unlawful interference by the participant or third party in general, Kyoto may at any time disqualify the entry; In the event of an entry that has already been declared the winner, Kyoto may forfeit the prize.
Draw - Winner.
9.The draw will take place on September 1, 2025 at 10:00 a.m. (Greek Local Time) at Kyoto offices among the valid participants.
10.If for any reason it is impossible to conduct the draw on the aforementioned day and time, Kyoto reserves the
right to change the day and time thereof with its prior notice.
Contest Prize
11.The prize of the draw includes:
• An Energy Efficiency Certificate (EEC) for a building selected by the winner.
12.The Prize is specific, cannot be exchanged, nor can it be requested to be replaced with another or redeemed in
cash or other gifts, at any price. It is clarified that the Prize is provided by Kyoto "as is" without warranty of any kind, express or implied, including, but not limited to, all warranties of suitability.
13. Kyoto, its employees and officers shall not be liable whatsoever, to the extent excluded from liability permitted by law, for any direct, indirect, moral, incidental or other damage arising out of or in connection with the making of this draw and the delivery of the said prize. Also, in no event shall Kyoto be liable for any direct or indirect damages, costs and expenses that may arise from any interruption, malfunction or delay or any other cause relating to the prize draw or the draw.
14.Furthermore, Kyoto shall not be liable, criminal or civil, to any winner or third party for any accident and/or damage and/or bodily or material injury caused to them directly or indirectly related to the Prize or for any other reason. Kyoto is exempt from the obligation to deliver a Prize in cases where in any way the terms of
participation in the Competition have not been met.
Winner Information - Receipt of prize.
15.After the draw and within two working days, the winner will be informed by telephone at the mobile phone number through which he took part in the Competition.
The winner, at any stage, may be disqualified if:
• For any reason, you do not fully accept these terms in their entirety, which are all considered essential.
• His/her participation does not meet any of the terms hereof.
• Any of the information he stated is false.
• For any reason, the attempt to contact the winner after two (2) days from the draw is fruitless.
• his/her participation is, at the discretion of the Organiser, itself the product of fraud or unlawful interference by the participant or a third party.
• or any reason does not accept the relevant declaration of acceptance of the gift.
16.By submitting his/her participation in the Competition, each candidate grants exclusively for the purposes of the draw to Kyoto, without any charge to the latter, a non-exclusive license to use his/her name, image and any other necessary element related to his/her personality and identity for the purpose of using such data in the context of advertising, promotions of the Prize Draw throughout and after its duration. Indicatively, in the context of this Competition, Kyoto reserves the right to publish the image of the participants / and their name, through photographic material, audio and video material in print and electronic media (television, magazines, Internet, social media such as Facebook, LinkedIn, News App, etc.) and in any other medium chosen by Kyoto in the context of promotion, advertising exploitation of the lottery.
17.Participation in the competition implies the explicit and unconditional consent of the participant to the registration of personal data concerning him in a file to be kept by Kyoto, for the purpose and in the context of conducting the Competition, in accordance with the provisions of the applicable national legislation and the General Data Protection Regulation (EU 679/2016).
Modification of Terms – Gifts.
18.The Organiser reserves the right to unilaterally change the terms and prizes at any time, postpone or cancel the Competition and the draw, without notice. In such case, Kyoto shall be under no obligation to compensate participants, the winner of such prize draw and/or any third party.
Limitation of Liability of Kyoto.
19.Kyoto and any affiliated companies, their employees and officers shall not be liable whatsoever, to the extent excluded by law, for any direct, indirect, moral, incidental or other damages arising out of or in connection with the making of this draw.
20.Kyoto shall not be liable in any event for any direct or indirect damages, costs and expenses that may arise from any interruption, malfunction or delay, performance and generally for the factual and legal status of the Competition prize.
Personal Data.
21. By participating in the Competition, the participant grants to the Organizing Company his/her unconditional permission and consent to the use and processing of his/her personal data to serve the purposes of the Draw.
22.Participation in the Competition implies the explicit and unconditional consent of the participant both for the registration of personal data concerning him in a file to be kept by the Organizing Company and for the processing of such data, in accordance with the provisions of applicable national legislation and the General Data Protection Regulation (EU 679/2016) in the context of the conduct and achievement of the purpose of
the Competition.
23. Regarding the winner of the draw and any runners-up, the Organiser informs that they will process their personal data, which they will collect in order to inform the winner and publish the results of the Draw, the general promotion – presentation of the Draw, in accordance with the specific provisions of these terms, as well as the implementation of all necessary actions for the delivery of the Prizes.
24. After the expiration of the period of participation in the draw and the delivery of the Prize, any data, personal or not, of the participants, the winner and any runners-up of the Competition will be destroyed, subject to the necessary information to serve the transaction relationship of the Organiser with its customers.
25. For any exercise by the winner of the Prize Draw and/or any runners-up of their rights deriving from the
provisions of national legislation and the General Data Protection Regulation (EU679/2016), the latter may contact a representative of the Organiser or send a relevant question to info@kyotoenergy.gr. Acceptance of terms – jurisdiction – applicable law. Participation in the Competition is equivalent to full and unconditional acceptance of all these terms, the draw procedure, the result of the draw and the process of final nomination of the winner. Any dispute that may arise regarding the Draw and the application of these Terms will be resolved amicably by a committee selected by the Organiser.
For any dispute that cannot be resolved as defined above in relation to the above Draw, the Courts of Athens are
exclusively competent and the applicable law is the Greek law.
